Marital Property

Texas law provides for a presumption that any assets accumulated during the marriage are community property and subject to division by the Court. Sometimes a spouse enters into a marriage bringing property or monies of their own. These assets would be called "separate property assets" and, if it can be proven that the spouse had them prior to the marriage, they are then protected from division. Either spouse can petition the court for a division of more than fifty percent of the assets accumulated during the marriage for various reasons.
